Welcome to DigitWallet. These Terms of Use (“Terms”) govern your access to and use of the services provided by DigitWallet, including cryptocurrency exchange, FX solutions, and other associated services (collectively, the “Services”). By accessing or using the Services, you agree to comply with and be bound by these Terms.
Definitions
1.1 “Company” refers to DigitWallet, including its subsidiaries, affiliates, directors, and employees.
1.2 “Account” means the user account you create to access the Services.
1.3 “Digital Assets” refers to cryptocurrencies, tokens, and other blockchain-based assets traded on or through the platform.
1.4 “Fiat Currency” refers to government-issued currencies such as GBP, USD, or EUR.
1.5 “Services” includes crypto-to-fiat exchange, fiat-to-crypto exchange, FX services, and other products provided by DigitWallet.
Eligibility
2.1 To use the Services, you must:
Be at least 18 years old (or the legal age in your jurisdiction).
Not be located in a restricted jurisdiction as per applicable laws.
Agree to these Terms and comply with all local laws and regulations.
2.2 DigitWallet reserves the right to refuse service to any user at its discretion.
Account Registration
3.1 Registration Process:
Provide accurate and complete information during the registration process.
Ensure that the email address and phone number provided remain valid.
3.2 Verification:
All users must complete a Know Your Customer (KYC) process.
DigitWallet reserves the right to request additional documentation for compliance purposes.
3.3 Account Security:
Keep your login credentials confidential.
Notify DigitWallet immediately of any unauthorized account access or security breach.
Services
4.1 Crypto and FX Exchange:
DigitWallet facilitates the buying, selling, and exchanging of Digital Assets and Fiat Currency.
All transactions are subject to applicable fees outlined in Section 9.
4.2 Wallets and Custody:
Users may store Digital Assets within DigitWallet’s custodial wallets.
Custody services are governed by the Custody Terms.
4.3 Savings and Yield Accounts:
Eligible users may earn interest on deposits. Specific terms apply.
4.4 Prohibited Activities:
You must not use the Services for illegal purposes, including money laundering, fraud, or terrorist financing.
DigitWallet may suspend accounts suspected of engaging in prohibited activities.
Fees
5.1 Transaction Fees:
DigitWallet charges fees for all transactions. These are transparently displayed at the time of the transaction.
5.2 Withdrawal Fees:
Withdrawal fees for Digital Assets and Fiat Currency are detailed in the [Fee Schedule](insert link).
Risk Disclosure
6.1 Digital Asset Risks:
The value of Digital Assets can fluctuate significantly.
By using the Services, you acknowledge and accept the inherent risks of trading.
6.2 No Financial Advice:
DigitWallet does not provide investment or financial advice.
User Obligation
7.1 Compliance:
Users must comply with all applicable laws, including tax obligations related to Digital Assets.
7.2 Accuracy of Information:
You are responsible for ensuring all information provided is accurate and up-to-date.
Suspension and Termination
8.1 Suspension:
DigitWallet may suspend your account for security, compliance, or operational reasons.
8.2 Termination:
Either party may terminate the agreement at any time by closing the account.
Intellectual Property
All content on the platform, including logos, trademarks, and software, is the property of DigitWallet or its licensors. Users may not copy, distribute, or modify any content without prior written consent.
Intellectual Property
DigitWallet values user privacy. Please refer to our Privacy Policy for details on how your data is collected, stored, and used.
Liability
11.1 No Liability for Loss:
DigitWallet is not responsible for losses due to market volatility or user errors.
11.2 Limitation of Liability:
DigitWallet’s liability is limited to the fees paid by the user for Services in the past 12 months.
Governing Law
These Terms are governed by the laws of Czech Republic. Any disputes will be resolved through arbitration in Prague.
Amendment
DigitWallet reserves the right to amend these Terms at any time. Users will be notified of significant changes.
